Toshiba and SanDisk Suing Hynix Over Suspected Flash Memory Technology Theft

Yesterday, "a former SanDisk engineer suspected of improperly providing technical data to Hynix," was arrested by Tokyo police. Today, Reuters is reporting that partners Toshiba and SanDisk have separately filed civil lawsuits against Hynix, seeking damages due to the suspected theft. While Hynix says it has not received the litigation yet, both Toshiba and SanDisk have confirmed the suits.

Toshiba, based in Japan, filed the suit with the Tokyo District Court. It estimates that the alleged leak resulted in "losses of at least 100 billion yen ($980 million)," but did not disclose whether that was the amount it was seeking. SanDisk, based in the United States, filed its suit in Santa Clara Superior Court, "seeking damages, an injunction and other remedies." Toshiba and SanDisk have been "partners in flash memory technology for nearly 15 years."

Back in 2004, Toshiba sued Hynix "for the breach of its flash memory patents," seeking damages and an injunction. The case was settled through a cross-licensing agreement with Hynix, so it'll be interesting to see how this plays out.
